Definitions

“Supplier” refers to Markets Italia Ltd. “Buyer” refers to the restaurant, business, or individual purchasing truffles. “Goods” refers to fresh or preserved truffles supplied by the Supplier.

Product & Quality

Truffles are natural, highly perishable products. The Supplier guarantees authenticity and quality at the time of dispatch. Variations in size, shape, colour, and aroma are expected and do not constitute grounds for rejection.

Pricing

All prices are market-driven and subject to change without notice. Quotes remain valid for 24 hours unless otherwise stated. Prices are exclusive of VAT (if applicable) and delivery charges.

Orders

Orders must be confirmed in writing (email, text, or ordering platform). Minimum order quantities or values may apply. Once confirmed, orders cannot be cancelled without written agreement from the Supplier.

Delivery

Deliveries will be made to the address specified by the Buyer. The Supplier will take all reasonable steps to preserve product quality during transport. Risk in the Goods passes to the Buyer upon delivery. The Buyer is responsible for immediate inspection and correct storage (cool, dry, and airtight).

Returns & Claims

Due to perishability, returns are not accepted except in cases of genuine quality issues. Claims must be reported in writing within 24 hours of delivery, with photographic evidence provided. Remedies are limited to replacement or refund at the Supplier’s discretion.

Payment Terms

New Buyers: payment in advance (proforma invoice). Approved Buyers: payment terms are 7–30 days from invoice date unless otherwise agreed. The Supplier reserves the right to charge statutory interest on overdue payments.

Force Majeure / Availability

Truffle availability is subject to natural conditions and seasonal harvests. The Supplier shall not be liable for failure to deliver due to factors beyond reasonable control, including but not limited to weather, transport disruption, or harvest shortages.

Liability

The Supplier’s liability shall not exceed the invoiced value of the Goods in question. The Supplier shall not be liable for indirect or consequential losses, including menu changes, lost revenue, or customer refunds.

Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
